How Balinese Settle a Dispute

Saturday, February 24th, 2007 by Sidarta Wijaya

A dispute involving Balinese on both sides will likely be settled out of courtroom. The court is considered the last resort for justice and settlement by Balinese, avoided if possible. The Balinese prefer to settle their difference or dispute peacefully, and if possible come to an agreement among themselves. For example a traffic accident involving Balinese on both side seldom end up in the court, they will settle the matter peacefully on the spot, the spirit of “menyama Bali” (all Balinese is a family) prevent Balinese from suing each other on the court over a trifle matter such as minor traffic accident. Even for a fatal accident that cost life, seldom end up in the courtroom, a settlement for this terrible accident will be reached in a forum involving prominent family members of both sides.

If agreement cannot be reached among themselves, Balinese will apply to the banjar (sub-village) or village leader to act as mediator for a friendly settlement. Disputes concerning rice fields or irrigation water are settled by a council of special agricultural society, the subak.

Yayasan Kemanusiaan Ibu Pertiwi (YKIP)

Friday, February 23rd, 2007 by Rucina Belinger

Yayasan Kemanusiaan Ibu Pertiwi (YKIP) or the Humanitarian Foundation for Mother Earth is dedicated to helping the needy in Bali through health and education programs.

YKIP is a foundation dedicated to improving the lives of the needy in Bali through Health and Education Projects. Established only days after the Bali Bomb Blast of October 12, 2002, YKIP’s founders were business people, doctors, officials and volunteers who assisted during the crisis. It soon became evident that in order to accommodate the tons (literally) of medical supplies and monetary donations from well-wishers around the world, a transparent and responsible organization needed to be established. As many of our founders are members of Rotary International, we were able to establish YKIP as such an organization in the eyes of potential donors. We received endorsements from the Australian Ambassador to Indonesia, the diplomatic community in Bali, and the Governor of Bali. Our members come from a variety of faiths and from many different nationalities.

During the period of 1920s and 1930s, the image of Bali as a paradise was first created. On that time, the Dutch government began promoting Bali as a tourism destination. The pioneers of tourism in Bali such as Hickman Powell, Collin McPhee, etc, bolstered the image of Bali as a paradise. For Hickman Powell Bali was a vast wonderland, embodied the dream of pastoral poets. For Collin McPhee, each part of the day in Bali had a quality, which revealed a particular aspect of the island. The morning was “a golden freshness” when the island ‘dripped and shone with moisture like a garden in a florist’s window’. In the middle of the day, Bali ‘had become hard and matter-of-fact. In the afternoon and in the evening its qualities shone through, as “it grew unreal, lavish and theatrical like old-fashioned opera scenery.
